The term Fair Use is assosciated with Copyright. Companies are given the Fair Use doctrine by the copyright law. This means that there is limited access on copyrighted material unless permission is aquired by the right holders.
Some examples of Fair Use are commentary, criticism, news reporting, and even teaching. Fair Use provides for the legal, but not licensed version or company of any copyrighted material.
To justify the use as fair, one must demonstrate how it either advances knowledge or the progress of the arts through the addition of something new.
